Visto D2: a lei não exige €10.000 de capital
O valor que circula como requisito é prática consular, não texto legal. O que a lei pede é outra coisa — e há três caminhos possíveis.
Procure por visto D2 e encontrará, repetido em dezenas de páginas, que é preciso depositar €10.000 de capital social. O número não está na lei. Vale a pena entender a diferença, porque ela muda a forma de montar o processo.
O que o texto legal diz
O artigo 60.º da Lei 23/2007 prevê duas situações distintas sob o mesmo visto.
Para atividade profissional independente, exige-se contrato ou proposta escrita de contrato de prestação de serviços no âmbito de profissões liberais, e habilitação para exercer a atividade sempre que aplicável.
Para imigrantes empreendedores que pretendam investir em Portugal, a lei admite três caminhos alternativos: ter efetuado operações de investimento; comprovar meios financeiros disponíveis em Portugal, incluindo financiamento obtido junto de instituição financeira portuguesa, e demonstrar por qualquer meio a intenção de proceder a uma operação de investimento; ou desenvolver um projeto empreendedor, incluindo empresa de base inovadora, integrado em incubadora certificada.
Nenhuma dessas alíneas menciona um valor.
Então de onde vem o número
Da prática consular. Os consulados avaliam se o projeto apresentado é viável e se os meios são coerentes com ele, e na leitura dessa coerência consolidou-se um patamar de referência. É informação útil — mas é uma expectativa prática, não um requisito legal, e tratá-la como se fosse lei leva a decisões erradas.
A distinção importa em dois sentidos opostos. Quem tem €10.000 e um projeto frágil pode ser recusado apesar do valor. E quem tem um projeto sólido com estrutura de investimento diferente da esperada pode defendê-lo, porque a lei admite mais de um caminho.
O valor deve ser coerente com o projeto apresentado. Um plano de consultoria individual e uma operação industrial não se sustentam com a mesma capitalização.
A ordem de trabalho
Uma nota operacional que poupa meses: o plano de negócio vem primeiro, antes de tudo o resto. É ele que determina a forma jurídica, a capitalização adequada e a documentação a reunir. Montar a empresa antes de ter o projeto definido costuma significar refazer.
E há uma mudança recente que ajuda: com a concessão do visto de residência passa a ser emitida uma pré-autorização de residência, com atribuição provisória dos números de identificação fiscal, de segurança social e do serviço nacional de saúde.

The figure circulating as a requirement is consular practice, not statute. The law asks for something else — and offers three paths.
Search for the D2 visa and you will find, repeated across dozens of pages, that you must deposit €10,000 in share capital. The figure is not in the law. The difference is worth understanding, because it changes how a case is built.
What the statute says
Article 60 of Law 23/2007 provides for two distinct situations under the same visa.
For self-employed activity, it requires a services contract, or a written offer of one, within the liberal professions, and qualification to carry out the activity where applicable.
For entrepreneur immigrants intending to invest in Portugal, the law allows three alternative paths: having carried out investment operations; evidencing financial means available in Portugal, including financing obtained from a Portuguese financial institution, and demonstrating by any means the intention to carry out an investment operation; or developing an entrepreneurial project, including an innovative start-up, within a certified incubator.
None of those paragraphs mentions a figure.
So where does the number come from
From consular practice. Consulates assess whether the project presented is viable and whether the means are consistent with it, and a reference threshold has settled into that assessment. It is useful information — but it is a practical expectation, not a legal requirement, and treating it as law leads to wrong decisions.
The distinction cuts both ways. Someone with €10,000 and a weak project can still be refused. And someone with a solid project structured differently from what is expected can argue for it, because the law allows more than one path.
The amount must be consistent with the project presented. A one-person consultancy and an industrial operation are not sustained by the same capitalisation.
The order of work
An operational note that saves months: the business plan comes first, before everything else. It determines the legal form, the appropriate capitalisation and the documents to gather. Incorporating before the project is defined usually means doing it twice.
And a recent change helps: on granting the residence visa, a pre-authorisation is now issued, with provisional allocation of the tax, social security and national health service numbers.
